On September 30, 2025, the Tennessee Court of Appeals issued a “stay” in the appeal by Governor Bill Lee and Attorney General Jonathan Skrmetti of the three-judge panel’s ruling which declared two of Tennessee’s gun control statutes unconstitutional. The ruling leaves the status of Tennessee law in confusion since the trial court had declared these statutes unconstitutional and, at this point, the Court of Appeals has not ruled on the constitutionality of the statutes.
In granting the stay, the Court of Appeals did not issue any detailed ruling regarding its decision to stay the three-judge panel’s ruling but instead the order cites only “upon due consideration.”
This development is further cause for the Tennessee Legislature to come into a special session to immediately address and repeal these statutes.
